Understanding Bankruptcy, the website at bkforeclosurecheck.com (the “Site”), is a free, educational tool operated by X Home Advisors, LLC (“we,” “us,” or the “Operator”). The Site explains, in general terms, how bankruptcy can affect a Texas foreclosure and produces theoretical, illustrative estimates based on figures you enter. By using the Site you agree to these Terms of Use. If you do not agree, do not use the Site.
We are not attorneys, a law firm, or a bankruptcy petition preparer, and nothing on the Site is legal, financial, or tax advice. The Site is not a substitute for the advice of a licensed attorney. Using the Site, contacting us, or relying on any output does not create an attorney-client relationship or any professional-client relationship of any kind. Only a licensed bankruptcy attorney who reviews your full circumstances can advise you on whether to file, which chapter to file, or what your actual costs and outcomes would be.
All numbers and explanations are simplified, general, and illustrative. They are not predictions, offers, approvals, or determinations of eligibility, and they do not reflect the many case-specific factors (income and expenses, all debts, property values, exemptions, prior filings, means testing, local court rules, trustee practices, and a judge's discretion) that determine a real bankruptcy outcome. Laws, fees, and court orders change. We make no representation or warranty that any figure or statement is current, complete, or correct for your situation.
The Site does not provide “bankruptcy assistance” for payment, is not a “debt relief agency” as those terms are defined in the U.S. Bankruptcy Code, does not prepare bankruptcy documents, and does not help anyone file. It charges nothing and collects nothing.
You are responsible for your own decisions. Before acting, you should consult a licensed bankruptcy attorney, keep in contact with your mortgage servicer, and independently verify any figure. Do not rely on the Site to determine deadlines; foreclosure and bankruptcy timelines are strict and case-specific.
The site and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or current.
To the fullest extent permitted by law, in no event will X Home Advisors, LLC or its members, managers, employees, or agents be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of property, money, savings, or opportunity, arising out of or related to your use of — or inability to use — the site or any reliance on its content, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the site will not exceed one hundred U.S. dollars ($100). Because the site is provided free of charge, you have paid nothing that could be refunded as damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You use the Site entirely at your own risk. You agree to indemnify and hold harmless X Home Advisors, LLC and its members, managers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
The Site links to third-party resources (for example, the State Bar of Texas, TexasLawHelp.org, and government sites) for convenience. We do not control and are not responsible for their content or services, and a link is not an endorsement.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to their jurisdiction.
We may update these Terms at any time by posting a revised version with a new “Last updated” date. Continued use after changes are posted means you accept them.
This Site does not collect, store, sell, share, or transmit any personal information. Everything you type stays in your own web browser and is used only to calculate the on-screen example. When you close or reload the page, it's gone. We can't see it, and it never leaves your device.
Information you enter: the figures you type (such as a mortgage payment or how far behind you are) are processed entirely in your browser (client-side) to produce the illustration. They are never sent to us or to any server, and nothing is saved.
No accounts, no tracking cookies, no ads: the Site has no login, sets no advertising or tracking cookies, sells nothing, and runs no third-party advertising trackers.
Basic hosting logs: like most websites, our hosting provider may automatically record standard technical request data (such as IP address, browser type, and pages requested) to operate and secure the Site. We do not use this to identify you and do not combine it with anything you type.
Third-party links: if you follow a link to another site, that site's own privacy policy governs — this policy applies only to Understanding Bankruptcy (bkforeclosurecheck.com).
Children: the Site is intended for adults and is not directed to children under 13.
Contact: questions about this policy can be directed to the Operator through the contact method published on the Site.
We want everyone — including people who use assistive technology — to be able to use this tool. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA: the Site uses semantic HTML, labeled form controls, visible keyboard focus, large touch targets, high-contrast text, and respects the “reduce motion” setting.
If you run into a barrier using this Site, please let us know through the contact method published on the Site so we can fix it.
